Biggest Myths About Mediation
No. 1 - Mediation is a sign of a weak case
FACT: Most courts require mediation before it will hear any temporary or final hearing. Going to mediation does not compromise your position. Mediation should be seen only as an acknowledgment of the magnitude of the legal costs that potentially lay ahead.
No. 2 - Going to Mediation requires the parties to reveal all their evidence
FACT: There is no requirement that parties come to mediation and present every argument they plan to make if the case goes to trial. However, mediation generally works best when there is a free flow of information.
No. 3 - Mediation will not work because "I am right" and "I want my day in court"
FACT: Black and White positions do not work in the real world - Especially in Family Law. There are many areas of gray. Mediation does not require you to give up the mantle of "being right" - it only asks that you listen and try to seek some resolution to the problem without incurring continuing legal fees.
No. 4 - Mediation is a waste of time because this case will never settle.
